Why pharma patents live longer

Drug patents have a special statutory extension (Hatch-Waxman PTE) up to 5 years for FDA regulatory review time. Biological patent claims are also narrower, so companies avoid infringement by filing continuation patents — keeping the family alive longer.

Why software patents get abandoned

Maintenance fees are due at 3.5, 7.5, and 11.5 years. Software products often have shorter commercial cycles; companies abandon patents when the underlying technology is no longer worth defending.

Patent term adjustment (PTA)

The USPTO must issue a patent within certain timelines. If it takes longer, the patent gets extra days (PTA). This is why some patents show 20+ year lifespans — they were literally granted extra time by law.
